Change of Placement and the Least Restricted Environment (LRE)

What's Required

The local educational agency (LEA) must ensure that to the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are nondisabled (34 CFR 
300.114(a)(2)(i) and 20 USC 1412(a)(5)(A).

The LEA must ensure that special classes, separate schooling, or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability of a child is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily (34 CFR 300.114(a)(2)(ii)and 20 USC 1412(a)(5)(A)

The LEA must ensure that a continuum of alternative placements is available to meet the needs of children with disabilities for special education and related services (34 CFR 300.115(a)).

The ARD committee must specify the appropriate instructional arrangement/setting as set forth in 19 TAC 89.63(c).


What We Do

Spring ISD Special Education Procedures for recommending changes to a student’s placement are outlined below

If student concerns suggest additional supports or services may be needed and the campus has collected multiple sources of data to support it: 
  1. Notify your assigned Special Education Campus Coordinator of concerns regarding student's current placement by completing page 1 of the Considerations for Change of Placement Form.
  2. Continue to collect data through documented observations, assessments, student work samples, behavior logs, etc. 
  3. Within 2 weeks of the initial notification, the Special Education Campus Coordinator and related staff, will schedule a time to visit the campus, observe the student, review the data, and meet with campus staff regarding the concerns and to offer support and services available to meet the needs of the student. The Campus Coordinator will make recommendations that will be implemented before considering a change of placement.  
  4. If it is determined, after 4 weeks of implemented strategies, that the interventions have not been successful, then the Campus Administrator and Special Education Coordinator will complete pages 2 and 3 of the Change of Placement Checklist Form ensuring that all resources have been utilized and that the team has reviewed all areas of the students circumstances before recommending a change of placement.
  5. If the recommended program will not result in a change of campuses, the campus will schedule a Review ARD to make placement recommendations.
  6. If the recommended program will result in the student changing campuses to access the recommended program, the campus coordinator will collaborate with the Special Education Director and the Assistant Superintendent to determine the location of services:
    1. The Spring ISD Intra-District Student Transfer Form will be completed and submitted to the School Leadership Office. 
    2. Once location is determined, the Special Education Coordinator will communicate with both the sending and receiving campus to review the recommendation(s) and schedule a staffing so that a transition plan can be developed.
    3. Following the staffing, the home campus will schedule a Review ARD, at a mutually agreeable time, between both campuses to make placement recommendations.
*Final decisions regarding student programming and placement will be determined by the student’s ARD committee.

Please contact your Campus Coordinator when:

1. A new student enrolls in your campus who receives specialized programming through special education
2. Your campus staff have questions/concerns about programming for a student on your campus
3. You are scheduling an ARD that you anticipate may be contentious or end in non-consensus 
4. A parent informs you he/she will be bringing an advocate or attorney to an ARD meeting
5. A parent shows up to an ARD with an advocate or attorney without prior notice
